In Timothie Bright and the Origins of Early Modern Shorthand, J. D. Fleming brings together two areas of sixteenth-century intellectual history. One is the period emergence of artificial systems for verbatim shorthand notation-a crucial episode in the history of information. The other is the ancient medical discourse of melancholy humour, or black bile. Timothie Bright (1550-1615), physician and priest, prompts the juxtaposition. For he was the author, not only of the period's original shorthand manual-Characterie (1588)-but also of the first (...) book in English on the dark humour: The Treatise of Melancholy (1586). Bright's account of melancholy involves a cybernetic phenomenology of the human. Essentially, we are psyches (souls or minds). We are sealed off from our bodies, operating them as automata across an interface. Psychological presence, for Bright, is illusion and pathology. Engrossing performances or representations therefore bring great danger, and so does the doctrine of predestination-less for its content than its typical delivery. Painful preaching was indispensable in sixteenth-century English Protestantism. But it falls foul of Bright's proscriptions. This is followed by his publication of the first known system for verbatim shorthand notation since antiquity, its technique heavily inflected toward a vocabulary of the pulpit. The passionate, oral performance of the inspired preacher receives an unprecedented textual preservative-and prophylactic. Bright's technology of information serves his phenomenology of alienation. John Fleming , later professor in Aberdeen and Edinburgh, made his combative contribution to natural history between 1812 and 1832. As an Edinburgh student he had followed Robert Jameson's ‘Wernerian’ lead. His earliest publications, from 1813, expressed what was to be a lifelong hostility to the work of James Hutton. Yet his own thinking moved increasingly towards a ‘uniformitarian’ as opposed to a ‘catastrophist’ view of earth history. His Philosophy of Zoology embodied criticism of Cuvier. More dramatically, he (...) became embroiled in controversy with Buckland and later with Conybeare. By then the ‘uniformitarian’ hypothesis had been adopted by Lyell, with whom Fleming was in close touch from the mid-1820s. Fleming may have had some grounds for feeling that his priority in advocating uniformitarianism was later overlooked. His History of British Animals included a preface in which he elaborated his earlier hypothesis as to ‘revolutions … in the animal kingdom’ correlated with six geological epochs. Tension had then developed in Fleming's relationship with Jameson, and the early 1830s found him in a mood of increasing frustration. Reconciliation with Buckland and approval by Sedgwick still left ‘the Zoological Ishmael’ feeling that his advancement in the scientific world was blocked, perhaps permanently. In historical perspective Fleming may be seen as a minor but not insubstantial figure in the scientific landscape of the early nineteenth century. (shrink)

The ongoing debates about what rationality consists in remain unsettled and leave plenty of interpretation for what is rational in belief formation and action. Hinman risks a large step in seeming to assume that it is rational not to contravene scientific theories and findings and irrational to disallow this openness. These -- possibilities lending a potential for deistic beliefs not to be inconsistent with rationality. The presumed scientific approach to allowing a rationality in such belief revolves around the development of (...) the so-called "M-scale" in the psychology of belief. The other, even more intense, global debate here is whether such an approach to rationality and rational belief is indeed valid, that is, the ongoing concen of whether such belief is consistent or not with scientific practice, understanding, and method. In this Article, I assess James E. Fleming’s Fidelity to Our Imperfect Constitution. For Moral Readings and Against Originalisms. For that purpose: in Part II, I reexamine Ronald Dworkin’s “moral reading”; in Part III, I reevaluate Fleming’s argument both “for moral readings and against originalisms”, which can be characterized as “fidelity to our imperfect constitution”; in part IV, I explicit three very helpful dichotomies to distinguish between moral readings, originalisms and legal pragmatism aka living constitutionalism: (1) fidelity (...) and anti-fidelity; (2) interpretation and non-interpretation aka (re)construction, (re)invention and (judicial) legislation; and (3) perfectionimperfection. Additionally, I reintroduce Lon L. Fuller’s distinction between “intelligent and unintelligent fidelity”, to point out the kind of fidelity that moral readers and everyone else must adopt: an intelligent fidelity; and, finally, I present my general conclusion.
